on the drive with kenny jones – we discussed how fast food chain mcdonald’s lost a lawsuit in malaysia after an appeals court overruled a decision that its trademark had been infringed by a local restaurant called mccurry.
the epic battle over the prefix, “mc” has taken close to a decade. 8 years the two restaurants have been fighting over the use of those two lil’ letters.
“where the learned judge, with respect, erred is to assume that mcdonald’s had a monopoly in the use of the prefix ‘mc’ on a signage or in the conduct of business,” judge gopal sri ram said, overturning a 2006 ruling in favor of mcdonald’s.
mccurry, by contrast, serves indian fast food from one restaurant in kuala lumpur as well malaysian dishes such as fish head curry and is short for “malaysian chicken curry,” according to the company website (www.mccurryrecipe.com).
i think the name “mcpuke” would be more fitting.
oh come on – you all were thinkin’ it!

in a way, i feel sorry for the fast food goliath getting slain by the smaller malaysian david. so tonight, i shall stuff my face with an honorary big mac…and double cheese burger…and i gotta have fries…and an apple pie too…and coke…
and yes - of course i’m gonna super size it!
this ruling sets up a legal precedent that essentially says: mcdonald’s doesn’t have a monopoly on the prefix “mc.” which will open the door for other companies to jump all over it…so long as their food is different from mcdonald’s.
